CelebrityMark.com (the “Company,” “we,” “us,” or “our”) operates an online marketplace and auction platform for celebrity-owned artifacts, merchandise, and memorabilia (the “Service”). These Terms & Conditions (“Terms”) govern your access to and use of the website www.celebritymark.com (the “Site”) and the Service provided therein.

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree with all of these Terms, you are expressly prohibited from using the Site and must discontinue use immediately.

1. ELIGIBILITY AND ACCOUNT REGISTRATION

 

1.1 Eligibility

 

The Service is intended for users who are at least 18 years old. By using the Site, you represent and warrant that you are of legal age and have the capacity to enter into a binding contract.

However, as items are unique and often historical, we do not warrant that product descriptions or other content of the Service are entirely accurate, complete, reliable, current, or error-free.

2.2 Authenticity and Provenance

 

We strive to verify the authenticity of all celebrity-owned items. Where applicable, items will be accompanied by a Certificate of Authenticity (COA) or documented provenance.

  • Disclaimer: While we take reasonable steps to ensure authenticity, all artifacts are sold “AS IS,” and we make no warranty or representation, express or implied, regarding the accuracy of the documentation or the item’s condition, age, history, or source, beyond what is explicitly stated in the item’s description.

2.3 Pricing and Availability

 

All pricing is subject to change. We reserve the right to limit the sales of our artifacts to any person, geographic region, or jurisdiction.

3. AUCTION-SPECIFIC TERMS

 

3.1 Bidding Rules

 

  • Binding Offer: Every bid placed is a legally binding and irrevocable offer to purchase the artifact at the bid amount.

  • Reserve Price: Certain auction items may have a confidential minimum selling price (“Reserve Price”). We reserve the right to bid on behalf of the seller up to the Reserve Price.

  • Winning Bid: The bidder who places the highest bid equal to or above the Reserve Price (if any) when the auction concludes will be the successful buyer.

  • Buyer’s Premium: A non-refundable buyer’s premium (a percentage of the winning bid) may be charged on all successful auction lots. This amount will be clearly stated on the item’s auction page.

3.2 Payment for Auction Items

 

Successful bidders must complete payment within [Insert Number, e.g., 7] days of receiving the final invoice. Failure to pay within this period may result in the item being offered to the next highest bidder or relisted, and the defaulting bidder’s account may be suspended.

All auction items and one-of-a-kind celebrity artifacts are generally considered final sales and are non-returnable and non-refundable.

5.2 Exceptions

 

Returns and refunds will only be considered under the following limited circumstances:

  • The item was not delivered to the shipping address.

  • The item you received is materially different from the description on the Site (e.g., demonstrably not the item pictured).

  • The item is proven to be counterfeit by a mutually agreed-upon independent expert, provided the claim is made within [Insert Timeframe, e.g., 90 days] of delivery.

Prohibited acts include, but are not limited to: criminal or tortious activity, circumventing security features, unauthorized advertising, making improper use of our support services, or engaging in any conduct that disrupts the Service.

8. DISCLAIMERS AND LIMITATION OF LIABILITY

 

THE SERVICE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SITE AND OUR SERVICES WILL BE AT YOUR SOLE RISK. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL CELEBRITYMARK.COM OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

 

9. GOVERNING LAW AND DISPUTE RESOLUTION

 

These Terms shall be governed by and construed in accordance with the laws of India. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Mumbai, Maharashtra, India.
